Welcome to Alcove Fitness (“Company,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your use of our website, booking system, and fitness facilities (collectively, the “Services”). By purchasing a membership, booking a space, or using our facilities, you agree to these Terms. Please read them carefully.

1. Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Services, unless expressly authorized in writing.

• By using the Services, you confirm that you meet this requirement.

2. Memberships & Reservations

• We offer Pay-as-you-go, Flex, Gold, and Trainer memberships. Details, pricing, and benefits are available on our website.

• Memberships are personal and non-transferable.

• Reservation limits, booking windows, and usage rules vary by membership type and may be updated periodically.

• Reservations are required to guarantee access; walk-ins are not permitted.

• Late arrivals or early departures do not entitle you to extended time.

• Missed sessions may be treated as “no-shows” and are non-refundable.

3. Payments, Cancellations & Refunds

• All fees must be paid in advance through our booking platform.

• Unless otherwise stated at checkout, all payments are non-refundable.

• Memberships that auto-renew will continue until canceled. You may cancel via your online account or by contacting us at least 14 days before the renewal date.

• Where required by law, we will provide advance notice of membership auto-renewals, including instructions on how to cancel.

• We may suspend or cancel your membership for non-payment.

• Prices may exclude applicable taxes or fees, which you are responsible for paying.

4. Facility Access & Hours

• Access may be granted through key fob, digital pass, or staff entry, depending on membership type.

• Facility hours and availability may change at our discretion, including for maintenance, emergencies, or special events.

• Temporary closures for maintenance, safety, or other operational reasons do not entitle members to refunds or extensions, unless closures exceed 14 consecutive days.

5. Facility Rules & Code of Conduct

• Proper attire (shirts, athletic bottoms, closed-toe shoes) is required.

• You are responsible for cleaning equipment after use and returning it to its place.

• Respect the privacy and quiet use of others; disruptive behavior, loud music, or phone calls are prohibited.

• Smoking, alcohol, illegal substances, and unauthorized supplements are not permitted.

• Food is not permitted; water and sealed non-alcoholic beverages are allowed.

• Pets are not permitted unless required as certified service animals.

• Guests and children are not permitted unless expressly authorized.

• We reserve the right to deny access for violations of these rules.

6. Health & Safety

• By using our Services, you confirm you are in good health and cleared by a physician to participate in exercise.

• You assume all risks associated with exercise and facility use.

• Equipment must be used only as intended; misuse may result in injury or damage.

• You agree to follow all posted safety signs and staff instructions.

• The facility may employ video surveillance for security and safety purposes, which is for operational and security purposes only and is not continuously monitored.

• No member may access the facility without first signing a Waiver & Release of Liability, which is incorporated by reference into these Terms.

7. Trainers & Third-Party Services

• Independent trainers using Alcove Fitness are not employees or agents of the Company.

• We are not responsible for advice, instruction, or services provided by third parties.

• Any disputes with trainers or third-party providers are solely between you and that party.

8. Personal Belongings

• Lockers are for temporary use only and may not be used for overnight storage.

• Alcove Fitness is not responsible for lost, stolen, or damaged items.

9. Privacy & Data

• We collect and process personal information in accordance with our Privacy Policy, available at [Insert Link].

• By using our Services, you consent to our data practices as described in the Privacy Policy.

10. Suspension or Termination of Services

• We may suspend or terminate your membership at our discretion if you:

• Violate these Terms,

• Engage in fraud or misuse of the Services, or

• Create a risk to safety or operations.

• Suspension or termination does not entitle you to a refund of fees already paid.

11. Intellectual Property

All logos, designs, content, and materials provided by Alcove Fitness are our property or licensed to us. You may not reproduce, distribute, or use them without prior written permission.

12. Limitation of Liability

To the fullest extent permitted by law, Alcove Fitness is not liable for:

• Indirect, incidental, or consequential damages;

• Loss of profits, data, or goodwill;

• Injuries, illnesses, or property damage arising from use of our Services.

13. Indemnification

You agree to indemnify and hold harmless Alcove Fitness, its officers, employees, and contractors from any claims, damages, or expenses resulting from your use of the Services or violation of these Terms.

14. Third-Party Links & Payment Processing

• Our website or booking system may contain links to third-party websites. We are not responsible for their content, accuracy, or practices.

• Payments are processed by third-party providers (e.g., Stripe, Square). We are not liable for their errors, system failures, or security breaches.

15. Modifications to Services & Pricing

We may modify services, pricing, or membership structures from time to time. Updates will be posted on our website and apply going forward.

16. Force Majeure

We are not liable for delays or failure to perform obligations due to causes beyond our control, including but not limited to natural disasters, government actions, labor disputes, pandemics, or power/internet outages.

17. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any signed Waiver & Release of Liability, constitute the entire agreement between you and Alcove Fitness and supersede any prior agreements.

19. Dispute Resolution

Any dispute arising under these Terms shall be resolved through binding arbitration or mediation in the District of Columbia, unless prohibited by law.

20. Changes to Terms

We may update these Terms periodically. The latest version will always be posted on our website. Continued use of the Services after changes constitutes acceptance.

21. Governing Law & Venue

These Terms are governed by the laws of the District of Columbia, and any disputes shall be brought exclusively in the courts of the District of Columbia.

22. No Waiver of Rights

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

23. Survival

Sections 12 (Limitation of Liability), 13 (Indemnification), and any other provisions which by their nature should survive termination shall remain in effect even after membership ends.
